Novo Nordisk Healthcare AG, the patent holder, lost an invalidation trial (Invalidation 2015-800114) filed by Laboratoire Français du ..., which is believed to be an interested party, and the Japan Patent Office ruled that "the patent for the invention related to claims 1 to 17 of Patent No. 4874806 is invalid."
The examiner of the Japan Patent Office cited "Exhibit 1" (document), "Exhibit 2" (document), and "Exhibit 3" (document) presented by the plaintiff as the basis for his decision.
During the examination stage at the Japan Patent Office, the examiner found "Exhibit 3" (document) among the above Exhibits A and presented it to the applicant.
However, this "Exhibit 3" (document) is listed as "X Document" in the "International Search Report" and is written by a Japanese author.
