【日英対訳】自叙伝を翻訳して逮捕されたが不起訴
自叙伝を翻訳した男性が逮捕されたが不起訴になった事件です。スペイン在住の男性が自叙伝を執筆し、これを熊本の会社から出版しました。

This is a case where a man who translated his autobiography was arrested but not prosecuted. A Japanese man who is resident in Spain wrote an autobiography that was published by a company in Kumamoto.
しかしこの男性はこの自叙伝をこの会社に無断でスペイン語に翻訳して販売しました。
これによりこの男性は逮捕されました。
However, the man translated his autobiography into Spanish and sold it without the company’s permission. For this, he was arrested on his return to Japan.
なぜ自叙伝を翻訳して逮捕されたのでしょうか？
Why was he arrested for translating his own autobiography?
翻訳するなどの翻案権は著作権者が有しているからです。
著作権は出版社が持っているのが通常です。自叙伝と言っても、出版社から出版した以上は、翻案権は出版社が持っています。
The reason is that the copyright holder has the right of adaptation, such as translation, and the copyright is usually held by the publisher. Even in the case of an autobiography, as long as the work is published by a publisher, the publisher has the right of adaptation.
この逮捕は「やり過ぎであった」と言われ、男性と会社の間には示談が成立し、会社は告訴を取り下げました。
しかし、ここは判断が難しいと思います。自叙伝だから無断で翻訳しても許される、という判断を認めてしまうと、自分に関係する著作であれば翻訳してもよい、というルールが浸透するのでは？という懸念があります。
The arrest has been called “excessive,” and a settlement was reached between the man and the company, with the company withdrawing its complaint. However, I think it is difficult to make a judgment here. If we accept the judgment that translating an autobiography without the permission of the copyright holder is permissible because of the nature of it being an autobiography, there is a concern that this rule—that it is permissible to translate any work as long as it is related to the translator in some way—will become widespread.
著作物の内容によって翻案権の例外を認めるよりは、著作権の知識を国民全体に浸透させることの方が重要と思います。
Rather than allowing exceptions to the right of adaptation depending on the content of the copyrighted work, I think it is more important to spread knowledge on copyright among citizens.
