【日英対訳】「鬼滅の刃」の模様はありふれているか？
「鬼滅の刃（Demon Slayer: Kimetsu no Yaiba）」の竈門炭治郎（Kamado Tanjiro）の「緑と黒の市松模様」をよく見かけます。
これが「ありふれた模様」といえるかが裁判所で争われています。
英訳
The green and black checkered pattern of the jacket worn by Tanjiro Kamado in “Demon Slayer: Kimetsu no Yaiba” can be seen everywhere. Whether this is a “common pattern” is currently being disputed in the courts.
レッドスパイスという会社がこの模様のバスタオルやパーカーなどを販売、輸入した行為が、不正競争防止法違反を問われています。
A company called REDSPYCE has been accused of violating the Unfair Competition Prevention Act by selling and importing bath towels, hoodies, and other goods featuring this pattern.
ここで問題になるのが、「緑と白の市松模様」がありふれた模様か否かです。
この模様の真似ではない、もともと緑と白の市松模様は「ありふれている」との主張が通れば、誰でもがこれを使えるはずです。
The question here is whether the green and white checkerboard pattern can be considered a common pattern. If the assertion that the pattern is not an imitation—rather, that the green and white checkerboard pattern has always been “commonplace”—is taken as given, then everyone should be allowed to use it.
不正競争防止法では「需要者の間に広く認識されている商品等表示であって、混同を生じさせるもの」あるいは「著名な商品等表示」が保護されます。
The Unfair Competition Prevention Act protects “an indication of goods or business that is widely recognized among consumers, and something that could create confusion” or “a well-known indication of goods or business.”
「緑と黒の市松模様」はもはや、鬼滅の刃を連想させるほど周知、著名になっていると私は考えます。多種類の色彩のうち、この2色を選んで、しかも市松模様にする取り合わせをすることは確率が低く、鬼滅の刃の周知度も考え合わせると、不正競争に意図があったと考えざるを得ないと思います。
I believe that the green and black checkered pattern has become so widely recognized and well-known to the point that it makes us think of Demon Slayer. It is highly unlikely that out of all the different colors available, these two colors were chosen and combined as a checkered pattern randomly, and considering the degree of well-knownness of “Demon Slayer”, it seems to me to have been an intentional act of unfair competition.
