This is the 332nd case in which the Intellectual Property High Court has ruled that the rights invalid.
The patent owner, SEA Co., Ltd., was sued for invalidation (Invalidation 2017-800130) by Kaiyo Denshi Co., Ltd., which is thought to be an interested party, but the Japan Patent Office's Trial Department ruled that the request for trial was invalid, and the patent rights were upheld.
Kaiyo Denshi Co., Ltd., which lost the case, appealed to the Intellectual Property High Court.
The Intellectual Property High Court ruled that the decision made by the Japan Patent Office on July 17, 2018 in Case Invalidation No. 2017-800130 is set aside, and accepted Kaiyo Denshi Co., Ltd.'s appeal.
In the ruling, the Intellectual Property High Court stated that "the Plaintiff's reason for cancellation 1 is justified, and the decision should be set aside."
"Reason for cancellation 1" is (an error in the decision to add new matter), and that "the decision that the amendment in question was made within the scope of the matters described in the original specification in this case is erroneous and should be set aside."
On the other hand, at the examination stage of the Japan Patent Office, the examiner did not make this decision (to add new matter).
Here again, it is proven that the judgment ability of the examiners at the Japan Patent Office is weak.
It is not acceptable to grant a patent based on the examiner's careless judgment at the examination stage of the Japan Patent Office.
Therefore, I believe that the Japan Patent Office should not have granted a patent to SEA Co., Ltd.'s application.
