【日英対訳】沖縄の専門学校で参考書のプリントアウト配布
沖縄の専門学校で生徒から教材費として1回に約7～10万円徴収し、実際には専門学校は市販の参考書を購入したが一部は生徒に渡さず、その画像をパソコンに保存してプリントアウトし、生徒に配布していたことがわかりました。報道によると、生徒は40冊中28冊を受け取っていなかったとのことです。

I t has been discovered that a vocational school in Okinawa collected about 70,000 to 100,000 yen from students in one go as textbook fees, then purchased some commercially available reference books. However, many of the books were not given out; instead, the school saved images of the books on a computer, printed the images out, then distributed these printouts to students. According to reports, only 12 of the 40 total books that should have been given to each student were actually given out.
この事件の知財における問題点は、著作権法違反の可能性があるということです。
The problem with this case in respect of intellectual property is that it possibly violates copyright law.
学校教育で著作物をコピーすることが全く認められないわけではありません。
「学校その他の教育機関(営利を目的として設置されているものを除く。)において教育を担任する者・・・は、その授業の過程における利用に供することを目的とする場合には、その必要と認められる限度において、公表された著作物を複製」することができる旨が、著作権法35条に規定されています。
M aking copies of copyrighted works for the purpose of school education is not completely unauthorized.
Article 35 of the Copyright Act stipulates that “a person in charge of teaching […] at a school or other educational institution (except one founded for commercial purposes) may reproduce a work that has been made public […] to the extent that is found to be necessary if the purpose of doing so is for usage in the course of those classes.”
この条文ではさらに、「当該著作物の種類及び用途並びに当該複製の部数・・・に照らし著作権者の利益を不当に害することとなる場合」は著作権侵害になることが規定されています。
This Article further stipulates that copyright infringement occurs “i f the action would unreasonably prejudice the interests of the copyright owner in light of the nature and purposes of the work, the number of copies that would be made […].”
専門学校が本を1冊コピーして配布していたとしたら、やはり複製権侵害の可能性は高いと思います。
If the vocational school made copies of even one book and distributed these to students, it will very likely be an infringement of reproduction rights.
