【日英対訳】鬼滅の刃の登場人物のうち3人の洋服の柄が商標登録
鬼滅の刃の登場人物のうち3人(冨岡義勇(とみおかぎゆう)、胡蝶しのぶ(こちょうしのぶ)、煉獄杏寿郎(れんごくきょうじゅろう))の羽織の柄が商標登録されました。

The patterns of the haori jackets worn by three characters from Demon Slayer: Kimetsu no Yaiba: Giyu Tomioka, Shinobu Kocho, and Kyojuro Rengoku, were registered as trademarks.

これら3つの商標は「眼鏡、貴金属、筆記用具、かばん類、被服、おもちゃ、人形など」ほか非常に多くの商品について出願され、登録されています。
These three trademarks were applied and registered for a wide range of designated goods, including “glasses, precious metals, writing materials, bags, clothing, toys, dolls” and others.
今後、集英社はこれらの模様を付した数多くの商品が販売されることでしょう。このような模様の商標を商標権者が使用する際に注意すべきことは、識別標識として使用するということです。
This must mean that a large number of products bearing these patterns will be sold by Shueisha. With this kind of pattern trademark, the owner of the trademark right should take care when using it as a distinctive mark.
ポパイ事件では「アンダーシヤツの胸部中央殆んど全面にわたり大きく、彩色のうえ表現したもの」は「目じるし」である商標としては使用されていないと判断されています(昭和49(ワ)393号、大阪地裁)。
In the POPEYE case, the court judged that “a mark which is colored and widely expressed on almost the entire surface of the center of the chest section of an undershirt” is not being used as a “distinctive mark” (Showa 49 (wa) No. 393, Osaka District Court).
商標は識別標識ですから、商標権者が商標登録された模様をたとえば洋服に使用する場合は、たとえば襟の織りネームや商品タグ、包装紙にもその模様を付して、他社の洋服との識別標識として機能させることが必要です。そうでないと商標的使用態様であると認められないことがあります。
A trademark is a distinctive mark, therefore if a trademark owner uses a trademark registered pattern on clothing, for example, they must also insert the pattern on the clothing label, product tag, or packaging to make the trademark function as a distinctive mark distinguishing it from other companies’ products. Otherwise, it may not be recognized as a trademark use.
この3つの商標は登録されたのですが、竈門炭治郎(かまどたんじろう)ほか2名の服の模様の商標登録出願には拒絶理由が来てしまいました。この点は次回お話します。
While these three trademarks were registered, reasons for refusal were given in respect of trademark applications for patterns on the clothing of Tanjiro Kamado and two other characters, about which I will explain in my next blog.
