FX Fairの利用規約テキスト版（翻訳可能）全文（2023年9月） 出金停止問題・分割出金の対策を考えるために

海外FXのFX Fairが、2023年8月から出金停止している問題について、被害にあった日本人はたくさんいると思います。再度、重要な個人情報の提出を求めるなどの不審な動きに心配になりますよね。

FX Fairから一時的に分割出金を申請するために求められた個人情報

出金が行えない状態の中、以下のような案内がFX Fair利用者に通知されました。

当社内で不正トレードが横行しており、弊社コンプライアンス部門より一部のお客様に対して本人確認書類の再審査を厳格にさせていただいております。
結果として利用規約46条、63条を逸脱したアカウント及びお取引を多数確認させていただきました。

今後の出金方法について
現時点で弊社が保有している資金を仮想通貨にてお客様に公平に分配させていただきます。

当初の出金ルールに伴い、定額出金の対象者は1アカウント内に5,000円(50USD)以上の残高を保有しているお客様を対象とさせていただきます。

定額出金の送金に伴い、申請ページにて定額出金の申請をお願いいたします。
定額出金の申請は【2023年9月15日前後】に申請フォームをメールにて送付させていただきます。
その際に、以下の対応が必要になりますため、予めご準備の上お待ちください。
-ご署名した同意書のアップロード
-ご準備いただいたUSDT(ERC20)Walletアドレスの入力
-本人確認書類の再提出
※すでにご提出された書類と同じファイルは使用できません。新たに撮影したものをアップロードする必要があります。
上記の対応が完了次第、申請いただいた方の審査を実行いたします。
その後、審査が問題なく完了したお客様を対象に、一斉に送金させていただきます。

このような状況の中で、FX Fairのルール（利用規約）、個人情報の取り扱いについて、改めて考えさせられたのではないでしょうか？

実はFX Fairの利用規約は、テキストではなく、画像で作成されています。しかも、改行の位置が不自然であることや、70ページにわたり違和感の多い英語で長文で書かれていること、変な英語＆画像で利用規約が載っているだけのため日本語に翻訳することができないなど、日本人に利用規約を読ませないような工夫が行われており、実際に利用規約は全く読まずにアカウント開設した人がほとんどでしょう。
