【無知はダメ】AIで生成した画像著作権の誤情報が多すぎる！
あまりにもネットの誤情報が多いため、この記事を書きました。
せっかく便利に自由に画像が作成できても、使い方次第で損をしたら残念ですよね。安全に使ってください。※海外では訴訟事例あり
ここでは、主要な生成AIツールである【ChatGPT】【Midjourney】【Stable Diffusion】【Leonardo AI】【Copilot】について、その利用規約をもとに著作権・知的財産権に関してまとめてみました。
また、他のAIツールで気になるものがあればコメント欄から教えて下さい！
1. ChatGPT
著作権➡作成者
OpenAIが提供するChatGPTを使用して生成したテキストや画像の著作権は、基本的にはユーザーに帰属します。ユーザーが作成したコンテンツは、自由に使用、編集、配布することができます。
利用規約の一部抜粋:
Subject to your compliance with these Terms, OpenAI grants you a non-exclusive, non-transferable, revocable license to access and use the Services solely for your own use. You retain ownership of any outputs you create using the Services, provided you have the necessary rights to the inputs used to generate those outputs.
2. Midjourney
著作権➡作成者※管理者側も権利を保有
Midjourneyを使用して生成した画像の著作権は、原則としてユーザーに帰属します。ただし、生成された画像はMidjourneyのコミュニティ共有コンテンツとされ、Midjourneyが使用する権利を持ちます。
利用規約の抜粋:
You own all Assets You create with the Services to the fullest extent possible under applicable law. There are some exceptions.
By using the Services, You grant to Midjourney, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable no-charge, royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, and distribute text and image prompts You input into the Services, as well as any Assets produced by You through the Service. This license survives termination of this Agreement by any party, for any reason.
3. Stable Diffusion
著作権:➡作成者
Stable DiffusionはオープンソースのAIモデルであり、生成された画像の著作権はユーザーに帰属します。ユーザーは生成した画像を自由に使用、編集、配布することができます。
利用規約の一部抜粋:
"You own the images you create with Stable Diffusion, and you are free to use them for any purpose, including commercial use, provided you comply with the license terms of the software."
Stable Diffusionを商業目的で使用できます。Stable Diffusionモデルは、商業的および非商業的目的のための画像生成をユーザーが許可する許可ライセンス下でリリースされています。

4. Leonardo AI
著作権➡有料版の場合、作成者。無料版の場合、管理者
Leonardo AIを使用して生成した画像の知的財産権（著作権含む）は、有料版ユーザーに帰属します。無料版の場合は管理者側が知的財産権を持ちます。
利用規約の抜粋:
If you are on one of our paid Subscriptions (Paid Subscriber), as between the Parties, subject to your compliance with these Terms, ownership of all Intellectual Property Rights in any Content you, or your Authorised Users, create while using the Platform will vest in you upon creation, and to the extent that ownership of such Intellectual Property Rights does not automatically vest in you, we hereby assign all such Intellectual Property Rights to you and agree to do all other things necessary to assure your title in such rights.
If you are on one of our free Subscriptions (Free Subscriber), as between the Parties, ownership of all Intellectual Property Rights in any Output you, or your Authorised Users, create while using the Platform will vest in us upon creation, and to the extent that ownership of such Intellectual Property Rights does not automatically vest in us, you hereby assign all such Intellectual Property Rights to us and agree to do all other things necessary to assure our title in such rights.
5.Copilot
著作権※コンテンツの所有権➡作成者
Microsoftは、ユーザーがオンラインサービスに提供したコンテンツの所有権を主張しないと明記されています。これは、提供したコンテンツの知的財産権がユーザーに留まることを意味します。
ただ、下記内容から、知的財産権はユーザーにあるものの、使用権に関してはMicrosoftが広範な権利を持つということが分かります。
利用規約の抜粋:
コンテンツの所有権。Microsoft は、お客様が本オンライン サービスに提供、投稿、入力、送信した、または本オンライン サービスから受信した、プロンプト、作成物、カスタマイズ品、指示、またはその他すべてのコンテンツ (フィードバックや提案を含む) の所有権を主張しません。ただし、お客様は、オンライン サービスを使用し、コンテンツを投稿、アップロード、入力、提供、または送信することにより、Microsoft、その関連会社、および第三者パートナーに対し、その事業 (すべての Microsoft サービスを含むがそれらに限定されない) の運営に関連して、プロンプト、作成物、カスタマイズ品 (GPT を含む)、および関連コンテンツを使用する許可を与えるものとします。これには、お客様が提供するプロンプト、作成物、およびその他のコンテンツを複写、配布、送信、公に展示、公に上映、複製、編集、翻訳・翻案、フォーマットを変更するライセンス権、およびこれらの権利をオンライン サービスのサプライヤーにサブライセンスする権利が含まれますが、これらに限定されません。本オンライン サービスを使用することは、本オンライン サービスを構成またはサポートする、基になるテクノロジ、知的財産権、またはその他のデータの所有権をお客様に付与することにはなりません。
まとめ
生成AIツールを使用して作成した画像の著作権と商用利用については、各ツールの利用規約に基づいて異なるため、利用前に公式サイトや利用規約を必ず確認することが重要です。一般的には、ユーザーに著作権が帰属し、商用利用も可能な場合が多いですが、特定の条件や制限がある場合もありますので注意が必要です。
