Facing an Eviction Lawsuit in Court

From March 2023, eviction negotiations began, which escalated to a lawsuit in September 2024.

Below is a brief summary of the events leading up to and during the trial, recorded here for reference.

(Note: "Exhibit #" refers to the plaintiff's evidence document numbers.)


Events Leading Up to the Lawsuit

2023

February 12
Received a document from Daito Trust Partners stating that the master lease agreement with the building owner would end in late February.

February 28
Two employees of the new management company (MS Building Support Co., LTD.) visited. Received the following documents:

"Notice of Change in Owner and Lessor" (Exhibit 5)
"Direct Debit Application Form" (Exhibit 6)

March 18

Representatives from the plaintiff (SMC Corporation) and the negotiation agent (My Life Housing Co.) visited. Received the following document:

"Request for Vacating the Unit" (Exhibit 8)
(Reason: Building deterioration. However, the actual purpose was to demolish the building for landscape preservation and green space creation.)
Notably, this building is a 4-story, 12-unit reinforced concrete apartment constructed by Daito Trust Construction, the parent company of Daito Trust Partners, in 2010 (legal useful life: 47 years).

Negotiations continued via email until September 2023 and then via both email and in-person meetings from October onward.

August 2
Received an initial offer for monetary compensation for eviction.


2024

January 25
Received the "Notice of Termination" (Exhibit 9) and a significantly increased compensation offer (six times the original amount).

March 15
Sent a web letter to the then-General Affairs Manager.

After being informed that the letter was undeliverable, I requested the content to be forwarded via email by the legal representative.

April onward
I became the sole resident of the building.

July 11
Received a registered letter (Exhibit 43) from the newly appointed General Affairs Manager (appointed on July 5) suggesting potential legal action.

July 15
Sent a registered letter to the new General Affairs Manager containing the full content of the letter previously addressed to the former General Affairs Manager.

August 1
Held the final negotiation with the plaintiff's legal representative.

August 9
Received a registered letter (Exhibit 45) notifying me of the impending lawsuit.


Trial Proceedings


September 19
Received Complaint and related documents from the Tokyo District Court.

October 17
Submitted Answer to complaint.

October 24
First oral argument.

November 29
Received Brief (1) from the plaintiff's legal representative by mail.

December 5
Second oral argument.

December 24
Received Brief (2) from the plaintiff's legal representative by mail.

2025

January 6
Submitted Brief (1).

January 9
Third oral argument and conclusion of the trial.

February 20
Scheduled judgement (attendance is not mandatory).

A Few Words


This case is not just an eviction lawsuit. The building in question has been the site of torture and human experimentation against me and is crucial for investigating anomalous health incidents (AHIs).

For these reasons, I have consistently refused to vacate the premises.

Furthermore, I have suggested possible measures to address these issues to the plaintiff, but they have been completely ignored.

I plan to document several episodes related to this case at a later date.
