国連・子どもの権利委員会の第91会期が終了：一般的意見26号の草案は11月公開予定

　ジュネーブで開催されていた国連・子どもの権利委員会の第91会期が終了しました（9月23日）。

　プレスリリースはまだ出ていませんが、閉会会合の動画アーカイブを確認し、いくつかの動きを紹介しておきます（9月26日追記：プレスリリースが出ました。23日付ですが、実際に掲載されたのは26日です）。

■　委員会は、今会期、一般的意見26号（とくに気候変動に焦点を当てた子どもの権利と環境）の第1次草案を採択しました。第1次草案は11月に公開され、意見募集が実施される予定です（一般的意見26号の作成をめぐる動きはマガジン〈子どもの権利と環境〉の関連記事を参照）。

　また、最近は原則として2年に1度開催されてきた一般的討議については、今後は一般的意見の作成プロセスに統合することが決定されました。国連・社会権規約委員会などは以前からこのようなアプローチをとっており、それにならったものと思われます。具体的な作業方法は今後検討されます。

■　通報手続に関する選択議定書に基づいて提出された通報について、委員会は今会期、8件の決定を採択しました。その内訳は次のとおりです。決定は第91会期のページに順次掲載される予定なので、詳細がわかればあらためてお知らせします。

－シリア北部の難民キャンプに収容されているフィンランド国籍の子どもについての事案に関わって、フィンランドの条約違反を認定。類似の事案として、〈国連・子どもの権利委員会、シリアで収容されている自国民の子どもの帰還をめぐってフランスの条約違反を認定〉も参照。
－スペイン領メリリャ在住の子ども（モロッコ国籍）に対する初等教育へのアクセス保障に関わって、スペインの条約違反を認定。おそらく4件の申立てについて同旨の決定が行なわれたと思われます。以前の投稿〈国連・子どもの権利委員会、外国籍の子どもに対する就学許可の遅れをめぐってスペインの条約違反を認定〉も参照。
－カナダからアイルランドへの子どもの国際的奪取をめぐり、アイルランドを被申立国として行なわれた通報について、国内救済措置が尽くされていないとして不受理を決定。
－デンマーク（女性性器切除のおそれがあるソマリアへの送還）とスイス（保護者がいないモロッコ国籍の子どもの庇護申請）を被申立国として行なわれた通報について、いずれの事案でも庇護または一時的滞在許可が与えられたため。審理打ち切りを決定。

■　今会期には8か国（審査順に北マケドニア、ウクライナ、ウズベキスタン、南スーダン、ドイツ、ベトナム、フィリピン、クウェート）の報告書審査が行なわれました。今回、南スーダンの第1回報告書が審査されて総括所見が採択されたことにともない、すべての締約国について少なくとも1度は総括所見が採択されたことになります（なお、米国は条約の２つの選択議定書は批准しているものの条約本体は未批准）。

－毎日新聞：ロシア、子ども50万人連行か　ウクライナ政府、国連委で訴え
　記事には「2月24日のロシア侵攻開始から8月12日までに子どもの死者は361人、負傷者は706人」とありますが、審査の冒頭にウクライナ政府代表団主席（社会政策相）が行なった声明では、子どもの死者379人・負傷者735人に増えています。

　報告書（パラ28以下）によると、ドイツは委員会の前回の勧告（2014年）を受け、2015年、ドイツ人権研究所（DIMR）内に独立機関として「国連・子どもの権利条約モニタリング機構」（Monitoring Mechanism for the UN Convention on the Rights of the Child）を設置しました。ただし、子どもの相談（苦情申立て）に対応するしくみは子どもの生活環境の近くに存在するべきであるとして、個別救済の権限は付与していません。ラント（州）・自治体レベルでこのような個別救済のための機関が設けられている例はあり、そのうち情報を整理してお知らせしたいと思います。なお、以前の投稿で簡単に紹介しましたが、2021年に可決された「子ども・青少年エンパワーメント法」ではラント（州）に対してオンブズマンの設置が義務づけられました。
