June 24, 2021: Difference between Authority and Power (「権限」の違い)

英文契約書の勉強をしています。英文契約書には「Authority」と「Power」がよく使われますが、どちらも日本語では「権限」となります。AuthorityとPowerの違いを辞書で調べると以下の通りです。

1. Oxford Leaner’s Thesaurus (オックスフォード英語類語活用辞典)
Power: the ability to control people or thing (人や物事を支配する能力。)
Authority: the power to give orders to people（人に命令する権限）

2. Difference Between Power and Authority (with Comparison Chart) - Key Differences
Power: the ability or potential of an individual to influence others and control their actions.（個人が他者に影響を及ぼし、他者の行為を支配する能力または可能性）
Authority: The legal and formal right to give orders and commands, and take decisions.（命令や決定をおこなう法的かつ正式な権利）

Power：権限。作為または不作為により法的関係に変動を生じさせる能力(ability)ないし地位。Right（権利）と同じ意味に用いられることもあるが、厳密には、法律または委任によって与えられた、特別な行為をする権限。（Power: authority. The ability or status to generate a change in a particular legal relationship by doing or not doing a certain act.）
Authority:権限。権能。（詳細説明なし）

Power: Legal authority to perform acts affecting legal rights and relationship, especially the authority of a legislative body to make laws on certain subjects, the other authority of other governmental bodies or officers to perform their respective duties. （法的権利や関係に影響をおよぼす行為をおこなう法的権限。特に、立法府がある特定の問題について法律を作る権限、他の政府系機関や職員がそれぞれの義務を履行する他の権限をいう）
