【重要/必読】GRASSのオリジナル楽曲の利用に関するガイドライン(BMSを含む)(旧版)

オリジナルでBMS楽曲を制作するにあたって、これが必要なのではないかと考えましたので、用意しました。
これは過去にアップロードした楽曲、これから投稿される非BMS楽曲にも適用されます。
私以外のコンポーザーによる楽曲の私による差分譜面には適用されません。
私の楽曲、並びにBMSを利用する場合は、絶対に一度は目を通しておいてください。

前提として、私の作品の著作権は基本的にGRASSに帰属します。
また、一部アレンジ・リミックス作品の著作権は原作者に帰属します。

コンテンツの使用について

私の楽曲の公式音源は、
・悪意が感じられない使い方をすること
・公序良俗に反した使い方をしないこと
・政治、宗教に絡ませた使い方をしないこと
・ナイトコア、重低音強化、○○時間/分間耐久化の禁止
・制作関係者以外の音源単体での投稿の禁止
以上の五つをお守りいただければ、自由に使用していただいて構いません。
音源のDLが可能になっていない楽曲であっても、私にご一報をくだされば楽曲のデータを差し上げます。
ただし、セルフリミックスを除くリミックス楽曲や、合作による楽曲はこの限りではありませんのでご注意ください。

また、RemixやBootlegに関しては悪意を感じないRemix/Bootlegであれば自由にしていただいて構いません。悪意云々については、Remix/Bootlegには原曲破壊がつきものだとは思いますが、とりあえずL9999999999999^99999999999とかU9みたいな原曲破壊の仕方は確実に悪意を感じたと判断させていただきますので、ラインは見極めましょう。

私の楽曲を利用した作品や、Remix/Bootlegに関しては、私にご一報いただければ、作品の視聴や確認、私からの宣伝等させていただきます。宣伝しないでほしいという場合は明記していただくようお願いします。

私のBMS楽曲をK-Shoot Maniaやstepmania等、他の音楽ゲーム/シミュレーター媒体での音楽ゲーム化は許可必須とさせていただきます。

非BMS楽曲に関しても原則同じとしますが、非BMS楽曲のキー音無しBMS化は禁止とさせていただきます。これには例外はありません。

BMSの二次配布に関しては、
・悪意のないBMS差分譜面に付随する形での配布
・公式なパッケージによる配布
以上二つの種類の二次配布に関しては公認とさせていただきます。
それ以外の二次配布に関しましては、黙認という形を取らせていただきます。
ここでの公認と黙認の違いについてですが、公認はこちら側でも宣伝をさせていただきますが、黙認はこちら側での宣伝はしない、というものになります。
宣伝して欲しくないという差分製作者の方は、私にご一報くださいますようお願いします。
万が一、二次配布品に起因するウィルス感染等の被害が出ても、こちらでは責任を負いかねますのでご了承願います。

公式音源の二次配布は、原則禁止とさせていただきます。

BMSの動画投稿等について

同梱譜面のオートプレイ動画はこちらでYouTubeにアップロードさせていただきますが、「1Pのみ・SUD+66・緑数字300(500ms)(BEGINNER譜面は緑数字600、1000msにします)・beatoraja特有のクリッピングノイズおよびその緩和による音量の調整(こちら少しだけ緩和しました)」この4つやその他の環境が見辛い場合、自前でのオートプレイの録画を推奨させていただきます。
が、それを動画投稿サービスにアップロードするのは、禁止という方向にさせていただきます。
人の手でプレイされた動画については自由に投稿していただいても構いません。これについては後ほど詳しく。
ここまでが同梱譜面についての話。

有志による差分譜面のオートプレイ動画は、各々の手で制作していただいて、各種動画投稿サービスに投稿していただけるようお願いします。

次にプレイ動画についてですが、これは同梱・差分問わずに自由に投稿してもらって構いません。ただし、理論値動画の場合は、ちゃんと人がプレイしたという証拠があるとありがたいです(例：手元動画、空打ち、選曲画面から外部にもわかる形でリプレイを再生している部分も録画する)。

そしてプレイ動画を自由にしているので、当然ですが生配信でのBMSのプレイや楽曲の使用も自由とさせていただきます。というか多分自分もやる。

差分譜面の作成について

差分譜面の作成は悪意を感じないものであれば自由です。ただし、必ず差分作者名をARTIST欄またはSUBARTIST欄に入れてください(obj:〇〇等、差分譜面であることがわかれば問題ないです)。

ここでいう「悪意」の判断基準は全て私の裁量次第となってしまうため、少々難しい部分はあると思いますが、少なくとも「常識の範疇」というものを守っていただければほとんど大丈夫だと思います。とりあえずL9999999999999^99999999999とかU9みたいな異常なまでに極端な原曲破壊だけは絶対にやめてください。それでもわからないと言う場合はとりあえず音を増やしたり減らしたり鳴ってる場所を変えたりしなければ確実に大丈夫です。

差分譜面の内容や名称についてなのですが、
・悪意が感じられない内容にすること
・公序良俗に反した要素は入れないこと
・政治、宗教に絡ませないこと
以上の三つを遵守していただくようお願いします。
ただし、そもそも同梱譜面や楽曲自体が公序良俗に思いっきり反している場合、「公序良俗に反した要素は入れないこと」は無効となります。
そもそもの楽曲/同梱譜面が公序良俗に反している場合は、こちら側の楽曲の概要に明記させていただきますので、そこで判断をしていただくよう、よろしくお願いします。

「例外」について

もちろんこの利用規約には、状況によって例外が存在します。

楽曲等が合作だった場合、相手方の利用規約と合わせて考えなければなりません。
コンテンツの使用・動画投稿・差分制作等について、こちらの利用規約とあちらの利用規約で大きなズレがある場合は、私にご一報願います。制作側で相談させていただき、その楽曲限定の特別な規約を用意させていただく可能性があります。
合作相手の方に報告するのは、相手方の負担が大きくなりかねないので、可能な限り避けていただけるとありがたいです。

BGA等の製作者が私でない他のクリエイターさんである場合があります。担当が私でない部分の利用につきましては、その部分を担当した方の利用規約に従ってください。
ただし、利用規約の関係でコンテンツの使用・動画投稿等に問題が生じる場合は、私にご一報ください。相手方のクリエイターさんの方に相談をさせていただき、その楽曲等限定の特別な規約を用意させていただく可能性があります。

また、以上のことを書いているからといって私と無関係な内容での他のクリエイターさんに関するご相談はご遠慮いただくようお願いします。

第三者による音源単体での動画投稿サイト、音源投稿サイトへの投稿と同梱譜面BMSのオートプレイの第三者による投稿を禁止していますが、これには例外があります。
例外とする内容は以下の通りです。
・DJ MIXにおいて楽曲を使用し、それを公開する場合
・ダイジェスト形式のメドレーにおいて楽曲/BMS譜面動画の一部を使用する場合(この場合フルは除きます)
これらに関しましては連絡なしでもOKとします。

About the use of content

The official sound source for my music is,
-Use without malicious intent.
-Do not use it in a way that is offensive to public order and morals.
-Do not use it in a way that is related to politics or religion.
-Prohibit the use of Nightcore, Bass-heavy sound reinforcement, and endurance for xx hours/minutes.
-Prohibit the submission of sound sources by anyone other than those involved in the production.
As long as you keep the above five points in mind, you are free to use the music as you wish.
Even if the sound source is not available for download, please let me know and I will provide you with the data for the song.
However, please note that this does not apply to remixes, except for self-remixes, or to songs that are co-productions.

As for remixes and bootlegs, as long as the remixes and bootlegs are not malicious, you are free to do as you please. As for malicious intent, I know that Remix/Bootleg always involves destruction of the original song, but I will consider any destruction of the original song such as L9999999999999^99999999999 or U9 to be malicious.

If you are interested in using my music in your work or Remix/Bootleg, please let me know and I will let you watch it, check it out, and promote it. If you don't want me to promote your work, please let me know.

Permission is required to make my BMS songs into music games in other music game/simulator media, such as K-Shoot Mania, stepmania, etc.

The same principle applies to non-BMS songs, but I will not allow non-BMS songs to be converted to BMS without key sounds. There are no exceptions to this rule.

For secondary distribution of BMS...
-Distribution in the form of a non-malicious BMS differential score.
-Distribution as an official package.
The above two types of secondary distribution will be recognized.
All other types of secondary distribution will be tolerated.
The difference between official approval and tacit approval is that official approval means that we will advertise your work, while tacit approval means that we will not advertise your work.
If you do not want us to advertise your work, please let me know.
Please understand that we cannot be held responsible for any damage, such as virus infection, that may occur due to secondary distribution.

Secondary distribution of official sound sources is prohibited in principle.

About posting BMS videos, etc.

I will upload the autoplay video of the included score to YouTube, but please note that it will be 1P only, SUD+66, green number 300 (500ms) (BEGINNER score will be green number 600, 1000ms), beatoraja specific clipping noise and its mitigation. If you have difficulty viewing the video due to these four factors or others, we recommend that you record your own autoplay.
If you have trouble seeing these four things or any other environment, I recommend that you record your own autoplay, but do not upload it to video services.
You are free to post videos that are played by other people. More on this later.
So far, we've talked about the included score.

For autoplay videos of differential scores made by volunteers, please make them by yourself and post them on various video posting services.

Next, play videos, whether included or not, can be posted freely. However, in the case of theoretical videos, it would be appreciated if there is evidence that the player played the game properly (For example, video of the player's hands, blank shots, and recording the part where the replay is played from the song selection screen in a way that can be seen by the outside world).

And since we're making play videos free, of course we'll also make it free to use BMS play and music in live streaming. I'll probably do it myself.

About creating a differential score

You are free to create differential scores, as long as they are not malicious. However, please make sure to put the name of the creator of the difference in the ARTIST or SUBARTIST field (obj:XX, etc., as long as it is clear that it is a difference score).

The criteria for judging "malice" here is entirely up to my discretion, so I think there are some difficulties, but I think most of it will be fine as long as at least "common sense" is observed. At any rate, please don't destroy the original song to an extreme degree, such as L9999999999999^99999999999 or U9. If you still can't figure it out, just don't increase or decrease the number of notes or change the location of the notes, and you'll be fine.

Regarding the content and name of the difference score,
-The content should not be malicious.
-Do not include any elements that are offensive to public order and morals.
-Do not make it political or religious.
I ask that you observe the above three.
However, if the included score or music itself is completely offensive to public order and morals, the "no offensive elements" clause will be invalid.
If the song/compound is offensive to public order and morals, it will be clearly stated in the song summary here, so please make your decision there.

About "exceptions"

Of course, there are exceptions to these terms of use, depending on the situation.

If the music is a joint work, it must be considered in conjunction with the other party's terms of use.
If there is a large discrepancy between our terms of use and theirs regarding the use of content, video submissions, differential production, etc., please let me know. We will discuss it with the producer, and we may be able to prepare special terms for that particular song.
We would appreciate it if you could avoid reporting to your collaborating partner if at all possible, as it may be too much of a burden for the other party.

There are cases where the creator of the BGA, etc. is not me, but another creator. Please follow the terms of use of the person who is in charge of the part when you use the part that is not mine.
However, if there is a problem with using the content or posting the video due to the terms of use, please let me know. I will consult with the other creator, and may be able to prepare special terms and conditions limited to that song, etc.

Also, please refrain from discussing other creators with content unrelated to mine, even though I have written the above.

There are exceptions to the prohibition against third party posting of sound sources on video and sound source posting sites, as well as third party posting of autoplay of the included music score BMS.
The exceptions are as follows,
-Use of music in DJ MIX and its publication.
-If you use a part of the music or BMS score video in a digest medley (excluding the full music).
In these cases, it is OK even without notification.
