　Yoko Kamikawa, Minister of Foreign Affairs made statement on coming IHR amendment.
 "New regulation or Amendment of the existing regulations does not
require the Diet to approve."

 This is a serious concern as this is a violation of THE CONSTITUTION OF JAPAN.

What is "Ohira’s Three Principles"?

Ohira’s Three Principles stipulate that the Diet’s approval is required under Article 73, item (iii) of the Constitution of Japan with respect to:

(i) international agreements that include any matters that must be formally prescribed by law (for example, a situation where the conclusion of the international agreement requires new legislative measures),

(ii) international agreements that include any financial matter, and

(iii) politically important international agreements.

So basically, you have already decided to create a legally binding document.
This is indeed a document created by the Ministry of Foreign Affairs.
If that's the case, according to the Ohira’s Three Principles which I mentioned earlier, it is needed to be ratified by the Diet.

The Diet needs to approve it first.
What I am saying is a general basic rule, isn't it?


Foreign Minister Yoko Kamikawa:
First of all, the Constitution of the WHO was submitted to the Diet and approved in the 26th year of the Showa Era. (1951)
In the Constitution of the WHO,

(Haraguchi: I am not asking you about the Constitution of WHO)
(Haraguchi: I am just asking you only whether the document is legally binding)

Foreign Minister Yoko Kamikawa:
To prevent an epidemic from spreading across the borders,
It would be the best if as many member states as possible could implement the adopted rules simultaneously.

So, based on this idea, when the World Health Assembly adopts new regulations, they become effective among all of the member states.

Our understanding is International Health Regulations falls into this category.

Approval of the Constitution of WHO by the Diet means the current process has been approved by the Diet.
So a new regulation or amendment of the existing regulations does not require the Diet to approve.
Our country is legally committed to their decision without agreeing to each one of the new rules and amendment.

I am going back to the Ohira’s Three Principles you mentioned earlier.
When a new regulation is adopted or any existing regulation is amended,
we follow the processes established by Constitution of the WHO, and our government takes appropriate steps such as establishing ministerial ordinances, until the effective date.

We request the Diet to revise the domestic law, if necessary.

　Many Japanese are started to realize what is happening.
　We don't consent this tyrannical form of government.
