Interview with Frédéric Caudron on PBA issues（English text）
PBA is spreading a lot of information about your case, why did you keep silent since almost 3 months?
I kept silent because I have been consulting with my lawyer how to handle the situation, and we filed an injunction at the court. PBA keeps putting out rumors and false story about me since the beginning of the season, to create a controversy to tarnish my name and hide the truth.
We have heard many rumors about the reasons for your conflict with the PBA, can we know the real reason?
The main reason for the conflict is my claim for the money I am missing from the first two years of the team league...
How is it possible?
First year, when I signed my contract with WOW (WOW is the management company of PBA), the deal was only about tours with X amount of money (it should be noted that players don't have the same contract with the same conditions, so the different cases can't be compared).
The second year, they asked me to sign for team league, the contract was in Korean, so I asked my manager (Kimchi at that time) to check the information in the contract. Kimchi was involved at the start of PBA and told me that the contract is OK, that I can sign it. I expected to be paid for team league as agreed. But the contract for the team referred to an amendment in the contract with WOW, where any new sponsorship amount will be paid to WOW. WOW got the money that was supposed to be given to me. It means the same guarantee but double time of playing, and as a consequence, stay almost all year in Korea. Also I had to pay the extra costs from my pocket: apartment for 1 year, car, furniture... WOW argues that they always fulfilled the contract, making Kimchi guilty of not paying the total of my guarantee. This is true, but it is another missing money with Kimchi, which I have on trial... but the missing money from the team league is fault of WOW. From the other side, Kimchi is accusing WOW of not paying their due...
From the third year of team league, I finally could negotiate a new contract and started to get a salary for team league.
Nobody knew there was a problem with Kimchi before you published the news in June. Can you explain what happened?
This is of course a problem of payment. Also they registered my logo in 2015 at their name without my permission (what I just discovered last summer).
How have you tried to solve the problem with PBA?
I am trying to solve this problem for a long time, but since the beginning of this year, I decided to put an end to it. I have been asking about my money for the first 2 years of team league. The person I messaged always answered next to the point, avoiding my questions. Afterwards, he accused me of treating him and PBA of thieves (I never insulted anybody like he pretended or used the words he mentioned), he even threatened me of a lawsuit of 5.000.000$ if I don't register for PBA. I was upset and asked him to cancel our contract with mutual agreement, without any cost from both parts, because it was impossible for me to continue in this atmosphere, but he refused and he kept threatening me of a lawsuit... besides that, they didn't pay 2 years of incentives (special reward from the sponsor for winning a tour), according to my contract. I had to fight for months before they admitted and pay the debt. Their reason was a "small mistake"...
What happened about your contract with the team? PBA
said that you refused to sign a new contract and that you wanted to play only the tours. What is the real story?
I never refused to sign with the team league, and it never was my intention to play only the tours with guarantee. I just wanted to solve my problem first...
PBA is arguing that you didn't register correctly. What is the issue?
I registered and paid my inscription fee, but I didn't sign the Letter of commitment because I don't agree with a specific point (nr 9 on the list) that says "If I am nominated by a PBA Team League Club, I must sign the player contract and comply with it". This clause is totally unlawful. I can't sign a paper with a clause saying that I am obliged to sign a contract before reading first, and to agree with the terms and conditions. Of course, I did it in the past but because of many conflicts, I don't trust anymore and will not sign anything before checking carefully. If other players agree and sign it without problem, doesn't mean that I have to do the same. PBA tried to make me sign this document 2 times at the door just before entering the playing room for my game. At that moment, I still didn't get any contract for team league. When all the player probably received the contract since long time. Anyway, if this point is so important as a rule, why did they allow me to play from the first day of the season?
Did you finally receive the team contract? Why you didn't sign it?
They told me that they will send me the contract in May, and I received it on the 4th of July. However, they announced my name in the team long time before I received the contract. I was still discussing with PBA about my problems of the first 2 years of team league. Anyway, I couldn't possibly sign the contract because some clauses were unacceptable for me.
What was different from last year in your team contract?
Among some unacceptable conditions, there was a starting date and no clear ending date (last year it was a clear starting date, till end of the season). Also, there was a clause about the use of my name for products without specifying any detail. So how could I accept to sign this contract? To give my business away for free??? If I would sign the letter of Commitment, point 9 (which they insisted so much to sign), then I should have to sign the team contract and accept everything what I mentioned before.
What about Welcome, did you have contact with them about this situation?
Welcome always behaved correctly towards me during the years. They proposed to compensate for the 2 years of team league in the new contract. We almost agreed on everything and the financial part was clear.
Then, why you didn't sign?
The early morning of July 11th, after my final, we had a meeting, and Welcome offered to solve the problem of my salary for the first 2 years of team league, although it was problem of WOW, and we reached an agreement. Finally, they cancelled the deal in the last moment, because of 2 reasons: First, I asked not to play Scotch double this year because this particular set was taking all my energy and was giving me a lot of frustration (no criticism to Tina, she did excellent job but I couldn't adapt mentally to it). Also it was affecting my individual set, and as a consequence, the team results. Obviously, I always want to have the best conditions for better performance for the team. I did more than my best during the last 3 years and I didn't think it could be a problem, to not play Scotch double this year. Last season, my team mates Seo and Han made clear that they didn't want to play Scotch Double for the same reasons, and their demand has been respected and understood. Second, I wanted to have freedom of practice without team obligation because I like to practice in the morning, when team mates prefer the afternoon. I don't want to force anybody to follow my rhythm if they are not comfortable (and opposite way). Once again, I didn't cancel the deal, I was open for further discussion. They just cancelled and told me immediately that they will search for a substitute.
What about your contract with PBA (WOW)?
WOW breached the contract because they didn't pay the first half of my guarantee on time (1st of July - remember that they showed me the contract of the team on the 4th of July), as clearly mentioned in my contract with them, however the negotiations were still running about the team, and I was playing the tour. There are consequences of breaching a contract, and I have been threatened, if I breach the contract with WOW, I would have to pay 5.000.000$ as a penalty. But they breached the contract, and no consequences for them? For sure I will not give up any of my rights...
According to PBA rules, if you refuse to sign a contract with the team, they can restring your participation for the individual tours. However, you are claiming the right to participate. What makes you believe that you have the right to play the tours?
First, I insist that I really have never heard, nor seen, neither in my contract, nor anywhere where such a rule is. And if the regulation is official, where is it published? Because point 9 of letter of Commitment says that, if you sign that letter, you have to sign the contract with the team, but not that you can't play the individual tour... now, I don't have a contract with the team, because they cancelled it, and I don't have a contract with WOW, because they breached it, it means that they are not paying me any guarantee, and I paid my inscription fee... why can't I play like the other players who are playing tours, without team and without any contract??? | should have the right to decide if I continue PBA tour or not. It is to me like an abuse of authority.
What happened after the last tour that you won, during the ceremony, and has been published everywhere?
Honestly, nothing happened. There was a wrong interpretation of a gesture and it has been exaggerated exponentially. Till now, I don't understand what was the problem. The worst part is coming: There was a photographer with a PBA press accreditation who attacked me and insulted me just before the press conference. I couldn't assist the press conference because of him. PBA didn't handle the situation correctly because nobody could guarantee my security and they didn't take him out of the press room. Afterwards, 4 days later, PBA made an announcement that they gave me a warning for not assisting the press conference. Can you believe it???
Did you get any explanation from PBA?
No, they didn't try to do anything at all to clarify the situation, and they waited too many days to create more controversy. It would have been easy to organize a meeting with Pheavy, PBA, and me, to clarify the situation and make a quick announcement without that absurd scandal...
According to some articles, you are earning a million euro's per year, including your guarantee and your prize money. Is it correct?
1 million dollars a year??? ahahah. If you take in account the 2 years of team league without salary and you remove from the prize money 5% that PBA is keeping, 22% tax in Korea, and tax in my country, I didn't earn that amount even in 4 years of PBA, including prize money and guarantee together.
Anything you want to say to end this interview? Can you summarize?
-IT WAS NEVER MY INTENTION TO STOP THE TEAM LEAGUE AND PLAY ONLY THE TOURS !!!
-I NEVER MADE NEW EXCESSIVE DEMANDS OR ASK MORE MONEY, I WAS JUST CLAIMING MISSING MONEY !!!
-I DIDN'T BREACH THE CONTRACT WITH PBA, THEY DID !!!
-I DIDN'T CANCEL THE CONTRACT WITH THE TEAM, THEY DID !!!
