イギリスワーホリ（YMS）2024 根拠を元に徹底解説 -Graduate Visa to YMS Visa

2024年イギリスのワーキングホリデー Youth Mobility Scheme (YMS)改定に伴い、筆者自身YMSのビザを申請し、申請が承認され、現在YMSビザでイギリスに滞在しております。

YMSビザ以前はStudent Visa (2021 - 2022)とGraduate Visa (2022 - 2024)でイギリスに滞在しておりました。


先に結論から申し上げますと、私はオンライン申請をイギリス国内で行い、Biometric infomation の提出をイギリス国外(日本)から行いました。(←ココ超大事)

この記事では、私が実際に行ったYMSの申請プロセス (Graduate Visa to YMS Visa)について紹介しております。また、こちらの記事は2024年の夏頃から秋頃にかけてのお話になります。

YMSの要件その１（ Requirements for applying for YMS Visa）

こちらは別記事にて詳しく紹介しておりますので、具体的な内容をみたいという方はこちらの記事を参照ください。

YMSビザを取得できる対象者(日本人)は、おおまかに以下の３点に該当する方です。

• YMSビザでイギリスに滞在したことがない

• £2,530 に相当する資金を所持していること　　

• 年齢が18歳から30歳までであること

①私はこの基準に当てはまっていたので、YMSビザの取得ができると考えました。

YMSの要件その２（Reasons for refusal）

こちら上記で紹介した記事にも含まれている内容ですが、”YMS 2.1. 申請者はPart 9: grounds for refusalに該当しないこと”に関連するものです。このGrounds for refusal はYMS含めの全てのビザ申請に関わります。

なぜこれが大切かというと、イギリス国外から申請しなさいという文言が公式ウェブサイトに記載されているにもかかわらず、私がイギリス国内からYMSを申請しようとしていたからです。

こちらはSection １から５に分かれており、各Sectionの大まかな内容は以下の通りです。

Section 1: Application of this Part - YMSルートの人は関係無し

Section 2: Grounds for refusal, or cancellation, of entry clearance, permission to enter and permission to stay - YMSルートの人に最も関連があるとしたらこのパート。虚偽の申請、必要な支払いを完了していない、犯罪歴、医学的な理由などなど様々です。

• Exclusion, deportation order or travel ban grounds

• Non-conducive grounds

• Criminality grounds

• Exclusion from asylum or humanitarian protection grounds

• Involvement in a sham marriage or sham civil partnership grounds

• False representations, etc. grounds

• Previous breach of immigration laws grounds

• Failure to provide required information, etc grounds

• Admissibility to the Common Travel Area or other countries grounds

• Debt to the NHS grounds

• Unpaid litigation costs grounds

• Purpose not covered by the Immigration Rules grounds

• Innovator fit and proper person requirement

• Medical grounds

Section 3: Additional grounds for refusal of entry on arrival in the UK - パスポート忘れ、関税に関する犯罪、子連れの場合、状況の変化などを理由に拒否される可能性があります。'状況の変化'という記載は非常に曖昧ですが、こちら詳細は記載されておりません。

Section 4: Additional grounds for refusal of permission to stay - YMSルートの人は関係無しor イギリスでホームレスになったことがなければ関係無し)

Section 5: Additional grounds for cancellation of entry clearance, permission to enter and permission to stay - YMSルートの人は関係無し、たたし学生ビザ、Skilled Workerビザの人はめちゃくちゃ関係あります。主に学生ビザ、Skilled Workerビザの人がビザを落とされる場合の理由が記載されてます。

②この中にYMSビザ申請においてイギリス国内から申請をしたことでビザ申請が拒否されるという記載はありませんでした。(←ココ超大事)

YMSの要件その３（Financial Requirement）

こちらは、Immigration Rules Appendix Financeの内容になります。冒頭のYMSの要件その1の中の一つ'£2,530 に相当する資金を所持していること'に関連したものです。

このいわゆる資金証明に関する記事は筆者自身も多く見てきましたが、イギリス政府の見解と異なることを書いている記事も散見され、筆者が混乱する原因ともなりました。

ここでは全ては紹介しませんが、筆者の状況に特に関連した３つの項目のみを紹介します。

FIN 2.1. Funds will not be considered if they are held in a financial institution where any of the following apply:
(a) the decision maker is unable to make satisfactory verification checks; or
(b) the financial institution is not regulated by the appropriate regulatory body for the country in which that institution is operating; or
(c) the financial institution does not use electronic record keeping.

FIN 4.1. If funds, savings or income were earned or acquired when the applicant was in the UK, they must have been earned or acquired lawfully and while the applicant had permission and was not in breach of any conditions attached to that permission.

こちらの二つ、FIN 2.1.とFIN 4.1. は、イギリス国内で合法的に稼いだお金で、イギリス国内の銀行が発行した資金証明でYMSの申請が可能だということを言っています。様々なビザ申請があるので当たり前と言えば当たり前なのですが、私はイギリスでしか収入を得ていないので、大前提としてYMSビザの資金証明にイギリス国内の口座が使用できることが非常に重要でした。

FIN 7.1. The most recently dated piece of financial evidence must be dated within 31 days before the date of application.

こちらはよく議論がされている資金証明の発行日に関わるものです。申請日から31日以内の日付で発行された資金証明でなければいけないというものです。
ここで重要なのが、「申請日」の定義です。私は政府公式Immigration Rulesのページ、Interpretationのセクションからこの定義を探し出しました。定義は以下の通りです。

“Date of application” means: If applying for entry clearance either:
(a) the date of payment of the relevant fee; or
(b) where a fee is not required, the date on which the application is submitted online; or
(c) where a fee is not required and an online application is not available, the date on which the paper application form is received by the Home Office.

この(a) がYMSビザに関連するものです。つまり、YMSの申請費用を支払った日が申請日と定義され、資金証明は申請費用を支払った日から31日以内に発行されたものである必要があります。(←ココ超大事)

これについては、ビザセンター来館日から計算されているブログ記事などを拝見しましたが、それは誤った解釈であると私は考えます。仮にビザセンター申請日から換算した日付だとすれば、私の実際に提出した資金証明は31日を大幅に越していることになり、適切な資金を証明する書類としてみなされなかったと思われます。

FIN 7.3. The financial evidence provided must cover the whole period of time for which the funds must be held.

最後の項目は、資金証明は全ての期間で証明する必要のある資金額を下回ってはならないこについて言及しています。

③上記で紹介した３つの項目から、イギリスの銀行で資金証明を発行し、かつオンライン申請とBiometricsの提出日（ビザセンターの来館日）に期間が空いても問題がないことの根拠を発見することができました。

まとめ

様々なリサーチの結果、私は以下の根拠をもとに、イギリス国内でオンライン申請、その後日本に一時帰国し、ビザセンターに来館するというスケジュールを組みました。そして実際にYMSのビザを取得することができました。

①以下の基準に当てはまっている

• YMSビザでイギリスに滞在したことがない

• £2,530 に相当する資金を所持していること　　

• 年齢が18歳から30歳までであること

②YMSビザ申請においてイギリス国内から申請をしたことでビザ申請が拒否されるという記載がない

③イギリスの銀行で資金証明を発行し、かつオンライン申請とBiometricsの提出日（ビザセンターの来館日）に期間が空いても問題がない
