ハンガリーで発生した日本人女性殺人事件に関する声明（全国女性シェルターネット）

2月14日、ハンガリーで発生した日本人女性殺人事件に関し、全国女性シェルターネットが声明を発表しました。
日本における家族法改正についても言及し、「パスポート発給における DV・児童虐待事案の共同親権適用除外が適切に行われるよう強く要望します」と述べています。

　２０２５年 1 月 29 日ハンガリーで日本人女性が死亡し、アイルランド人の元夫が逮捕・訴追され た事件が報道されています。また、その被害女性は複数回にわたって日本大使館に相談していた こと、地元警察に相談していたこと、そして、子どものパスポート発給について相談をしていたこと などが報道されています。つきましては、私たちは、以下のことを危惧し、二度とこのようなことが 起きないよう、要望します。

  1.  外国人であっても、ハンガリー警察を含むすべての国の警察が DV 等の相談に真剣に対応し、 被害者を守ることを求めます。

  2. 各国にある日本大使館が、在外邦人とその子どもから DV や児童虐待などの相談を受けたと きに、表面的な情報提供にとどまるのではなく、保護など（大使館への保護を含む）できる限り 適切な援助（例えば裁判・弁護士費用等の援助、生活支援・心理的支援、現地当局等との緊密 な連絡調整など）を行うこと。

  3. ハンガリーはハーグ条約の締約国ですが、子どもの不当な連れ去りを防ぐ同条約によって、 DV や児童虐待被害者が安全に逃れられなくなることは、あってはなりません。DV・児童虐待 事案の大使館への相談対応においては、ハーグ条約における DV 虐待事案についての考え方 をしっかりふまえて行うこと（＊）。

  4. また「未成年者のパスポートの発給には共同親権者である元夫の同意が必要」だという説明が 日本政府の記者会見で語られていますが、これを DV や児童虐待があるケースにも機械的に 適用して被害者の保護や避難ができないような事態は発生させてはなりません。ハンガリー警 察や相談支援関係当局、パスポート発給当局及び日本の外務省・日本大使館は、このような誤 った対応をすることのないよう、強く求めます。
    　併せて、日本における２年後の家族法改正においても、同様に、パスポート発給における DV・児童虐待事案の共同親権適用除外が適切に行われるよう強く要望します。

＊なお、大人の DV を目撃する子どもは、児童虐待防止法により被虐待児と定義されており、DV がある家庭では 子どもの安全が脅かされていると考えるべきです。

Statement regarding the murder of a Japanese woman in Hungary

 The reports emerged regarding the death of a Japanese woman in Hungary on January 29, 2025, and the subsequent arrest and prosecution of her Irish ex-husband. It has also been reported that the victim had sought assistance multiple times from the Japanese embassy, consulted with the local police, and inquired about the issuance of a passport for her child.

In light of these circumstances, we express our deep concerns and strongly urge measures to ensure that such a tragedy never occurs again.

  1. We urge all police authorities, including the Hungarian police, to take reports of domestic violence (DV) and related concerns seriously, regardless of the victim’s nationality, and to take decisive action to protect victims.

  2. We call on Japanese embassies worldwide to go beyond merely providing superficial information when receiving reports of domestic violence or child abuse from Japanese nationals and their children. Instead, they should offer the most appropriate support possible, including protection (such as sheltering victims at the embassy), financial assistance for legal proceedings and attorney fees, livelihood and psychological support, and close coordination with local authorities.

  3. Hungary is a signatory to the Hague Convention, which aims to prevent the wrongful removal of children across borders. However, the convention must not be used in a way that prevents victims of domestic violence (DV) or child abuse from escaping to safety. When embassies handle consultations related to DV and child abuse, they must carefully consider the Hague Convention’s approach to such cases (*).

  4. The Japanese government has stated in a press conference that "the issuance of a passport for a minor requires the consent of the other parent with joint custody, including a former spouse." However, this requirement must not be applied rigidly in cases involving domestic violence or child abuse, as doing so could prevent victims from seeking protection or fleeing to safety. We strongly urge the Hungarian police, relevant support and consultation authorities, passport issuance authorities, as well as Japan’s Ministry of Foreign Affairs and Japanese embassies, to ensure that such harmful misapplications do not occur.

 Additionally, we strongly call for Japan’s upcoming family law reform, set to take effect in two years, to appropriately exempt cases of domestic violence and child abuse from joint parental consent requirements for passport issuance.

*It is important to note that children who witness domestic violence are legally recognized as victims of abuse under the Child Abuse Prevention Act in Japan. Therefore, in households where domestic violence occurs, it must be assumed that the safety of the child is also at risk.
